If you visit or sign up with carpoolindia.net it is presumed and understood that you accept and are bound by all these conditions.

3. Applicable Law

This site is created and controlled by carpoolindia.net in Mumbai India; as such the laws of India shall apply; courts in Mumbai shall alone have jurisdiction (subject to Arbitration at Mumbai) in respect of all the terms, conditions and disclaimers. carpoolindia.net reserves the right to make changes to the site and the terms, conditions and disclaimers. The membership is deemed to have been entered into at Mumbai, India and the laws of India will govern the membership. All the disputes arising out of or in any way affecting the membership including interpretation of any of the terms are to be referred to arbitration at Mumbai under the Arbitration and Conciliation Act (Indian Acct) at Mumbai before a sole Arbitrator.

4. Eligibility:

You represent and warrant that you are competent and eligible to enter into legally binding agreement and have the requisite authority to bind the other party to this Agreement. You shall not use this Site if you are not competent to contract under the applicable laws, rules and regulations. By registering on carpoolindia.net you explicitly understand and agree that:

* The minimum age for registering is 18 years for both men and women.

*You are not disabled by any law from entering into a contract.

* You have gone through the Terms and Conditions and agree to be bound by them.

5. MEMBERSHIP

Membership is not automatic: The right of admission vests with carpoolindia.net at it's sole discretion. You become a member upon due acceptance of the Profile/Payment by carpoolindia.net. Membership and rights of admission is reserved solely for

(a) Indian Nationals & Citizens

(b) Persons of Indian Origin (PIO)

(c) Non Resident Indians (NRI)

(d) Persons of Indian Descent or Indian Heritage.

Our membership is only for personal use. It is not to be assigned, transferred or licensed so as to be used by any other person/entity.

We have at any stage right to refuse or reject the membership without assigning any reasons.

6. Term.

You may terminate your membership at any time, for any reason by writing to support@carpoolindia.net. carpoolindia.net may terminate your access to the Site and/or your membership for any reason effective upon sending notice to you at the e-mail address you provide in your application for membership or such other e-mail address as you may later provide to carpoolindia.net. However, carpoolindia.net reserves the right, in its sole discretion, to terminate your access to the site and the related services or any portion thereof at any time, without notice. The provisions of Sections 13,14,15,16 and 18 of the Contract Act shall survive any such termination.

7. Modification of Terms and conditions of Service:

carpoolindia.net may at any time modify the terms and conditions ("Terms") of the Service without any prior notice of intimation to you. You can access the latest version of the Terms at any given time. You should regularly review the Terms. In the event, the modified Terms are not acceptable to you, you should discontinue using the service. However, if you continue to use the service you irrevocably agree to accept and abide by the modified Terms.

8. Registration Data:

To avail of and use the Services you will have to register with carpoolindia.net. As a part of registration process, you agree to provide to us complete and accurate registration information (the "Registration Data") as prompted to do by the Service and to maintain and update this information as required to keep it current, complete and accurate.

If you provide any information that is untrue, inaccurate not current or incomplete or carpoolindia.net has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, carpoolindia.net has the right to indefinitely suspend or terminate your membership without assigning any reasons and refuse to provide you with access to carpoolindia.net.

We accept no liability for any errors or omissions, whether on behalf of itself or third parties.

(v) You release and indemnify us and/or any of our officers and representatives from any cost, damage, liability or other consequence of any of the actions of the Users of the Site and specifically waive any claims that you may have in this behalf under any applicable law. Notwithstanding its reasonable efforts in that behalf, we can not control the information provided by other Users which is made available on the Site. You may find other User's information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense and safe practice while using the Site. Please note that there are also risks of dealing with unwanted and wrong people as also with people of unsocial elements.

13. Content Posted on the Site.

You understand and agree that carpoolindia.net may delete any content, messages, photos or profiles (collectively, "Content") that in the sole judgment of carpoolindia.net violate the Terms of Use or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of other carpoolindia.net and/or its Members.

You shall not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer and you agree to accept responsibility for all activities that occur under your account and password. carpoolindia.net and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel subscription in their sole discretion.

User specifically agrees that carpoolindia.net shall not be responsible for unauthorized access to or alteration of your transmissions or data, any material or data sent or received or not sent or received, or any transactions entered into through a carpool site/service. users specifically agree that carpool is not responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another's rights, including intellectual property rights. Users specifically agree that carpoolindia.net is not responsible for any content sent using and/or included in a carpool site/service by any third party.

15. Indemnity:

User agrees to defend, indemnify and hold harmless carpoolindia.net, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon the use of User's actions or inactions, including but not limited to any warranties, representations or undertakings or in relation to the non-fulfillment of any of its obligations under this Agreement or arising out of the User's infringement of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this Agreement.

17. ELECTRONIC COMMUNICATIONS:

You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
